In gun debate, two sides speak different languages

WEXFORD, Pa. (AP) ? Inside the Big Buck Sport Shop, where mounted moose and deer heads loom over rifles, handguns, targets and ammunition, the customers have no doubt: More gun laws will not save lives.

Fifteen miles south, in the city of Pittsburgh, many confronted by a steady stream of gun violence are just as certain: To reduce the carnage, stricter gun control is needed.

This divide has existed for decades, separating America into hostile camps of conservative vs. liberal, rural vs. urban. As the nation responds to the massacre of 20 children and six adults in Newtown, Conn., the gulf has rarely felt wider than now.

After the gunman invaded an elementary school with a Bushmaster AR-15 semiautomatic rifle and magazines of 30 bullets each, there was a brief moment of unity amid the nation's grief. Across partisan divides, politicians said something must be done about weapons based upon military designs. Many wondered if even the National Rifle Association would adjust its staunch opposition to gun control.

Then both sides regrouped. With President Barack Obama pushing for a ban on assault weapons and high-capacity magazines, and memory lingering of Obama's divisive 2008 comment that some Americans "cling to guns and religion," positions hardened.

Listening to the public discourse, and to citizens in places like Pittsburgh and the Big Buck Sport Shop, people seem to be speaking different languages entirely. Communication has broken down amid a flurry of accusations, denials, political maneuvering and catch phrases.

"You have to place some people in the category of 'you cannot communicate with them,'" Big Buck salesman Dave Riddle said Friday, standing between a rack of rifles and a glass case full of used handguns. "Their minds are set; they cannot change."

A short drive away, at the New Pittsburgh Courier newspaper, editor and publisher Rod Doss pondered how to tell gun enthusiasts about his belief that assault weapons should be banned.

"I don't know that they would hear me," Doss finally said. "Their culture is totally different. They've grown up around guns. It's part of their life and their lifestyle. It's second nature. Hunting, shooting, it's the love of guns."

Doss does not own a firearm: "I don't feel a need for any. I personally don't live in fear." His newspaper, which covers the African-American community, publishes detailed information on every Pittsburgh homicide because most are black-on-black crimes.

"I'm awestruck with their fascination with guns," Doss said of his suburban and rural neighbors. "When you look at it from that perspective, it's hard to relate to anything."

Locally, nationally, even globally, this is the issue that places people at odds ? a fact seen by the passionate, often angry conversations that are ringing out across the world in the days since the Newtown shootings. Harry Wilson, author of "Guns, Gun Control and Elections: The Politics and Policy of Firearms," sees common misperceptions on both sides.

Wilson, a Roanoke College political science professor, would like gun control advocates to know: "Gun owners are not idiots. Gun owners are not in favor of gun violence. Gun owners are in many ways like them, and would genuinely like to see gun violence reduced. Obviously they have a different solution. But they're people too, just with different perspectives."

"And what I would want gun owners to know is, the large majority of people in favor of gun control don't really want to take all of your guns."

Guns were inseparable from America even before their enshrinement in the Second Amendment. With guns we secured the nation's independence, seized vast territory from indigenous peoples wielding arrows and tomahawks, and forged an ethos of personal freedom. Today, according to most estimates, there are about 250 million guns in our nation of 310 million people.

America has a higher rate of gun deaths than most similarly developed nations: 3.2 firearm homicides per 100,000 people in 2009, according to a report by the United Nations Office on Drugs and Crime. That compared with a rate of 0.5 per 100,000 in Canada; 0.2 in Spain; 0.2 in Germany; and 0.1 in the United Kingdom and Australia. No data was available for Russia.

To many gun enthusiasts, though, these numbers have nothing to do with guns themselves.

With so many guns in circulation, they say, people intent on killing will always find a way to do it. Nor do they fault high-capacity magazines, because it can take only seconds to reload a standard 10-bullet version.

Some even say the solution to gun violence is more guns ? to deter, and to fight back against the bad guys.

"The easy, lazy conclusion is that (gun violence) has to do with firearms," said Sam Liberto, a business consultant shopping in Big Buck with his two young sons. "We should look at the root cause: parenting or lack thereof, mental illness, video games. The underlying forces are probably far more important."

Liberto does think gun laws could be tightened, to track and collect more sale information. He's against an assault weapons ban but expects one to happen soon, as a first step to outlawing even more guns.

So after Newtown, Liberto hustled to buy the same type of semiautomatic rifle used by the school gunman. On his iPhone was a photo of his weapon's handiwork: an Osama bin Laden target that featured a face full of bullet holes.

"It's a target item," Liberto said of his purchase. "Unlike a hunting rifle or a sport shotgun it has less kick, a lighter weight. It's designed to be carried. It's just nice, a nice gun to shoot."

Liberto and Riddle, the Big Buck salesman, are officers of the Millvale Sportsmen's Club, where target shooters and hunters enjoy their pursuits. Riddle knows many people who enter competitions with the type of AR-15 used in Newtown.

The gray-bearded Riddle has been around firearms since he was born in rural Pennsylvania. To him, guns are no more dangerous than an axe or a bat.

What would he tell people who want more gun control?

"Let's go out and shoot a little bit," Riddle offers. "I'd take 'em out, introduce them to firearms, show them the safety aspects of it. I'd just go out and start shooting, have some fun. Shoot some paper targets, some cans. Shooting guns is a lot of fun, it really is."

That's incomprehensible to Pittsburgh resident Valerie Dixon, whose law-abiding 22-year-old son was killed in Pittsburgh a decade ago by a neighborhood thug with an illegal .357 Magnum.

"The original purpose of the Second Amendment was not a sport," she said. "I do think the laws need to be looked at. Look at lifestyles as they are today, as opposed to when they created the Second Amendment."

Dixon doesn't only blame guns for her tragedy. She said better parenting and education are among many other factors that need to change. But still: She says her son's killer was able to obtain the fateful gun within two hours.

"I believe in the Second Amendment and the right to bear arms, but I believe there's a responsibility with our rights," said Dixon, who does not own a gun.

How to draw the line? That would require consultation and cooperation. Those who don't own guns might have to learn things from those who do. People who like to shoot military-style weapons might have to sacrifice some of their recreation.

Or sacrifice some of their way of life.

Over the Christmas holiday, James and Jennifer Shafer shot guns with their parents and young kids at their ranch an hour north of Pittsburgh. The Shafers feel the pain of parents who have lost children. The Newtown killings left them shaken. But the response scares them, too.

"You can't take away our right to protect ourselves," said James Shafer, a former Marine who has called his congressional representatives to voice his opposition to laws that limit guns.

"We're not going to give them up, that's plain and simple," he said.

"I don't know how to get on the subway in a big city," said his wife, Jennifer. "I've heard bad things about it, and I'm scared of it. But the subway is normal for other people . guns are the thread of our culture."

James' cousin, Erik Shafer, started buying guns a few years ago after he returned to his rural home and found it ransacked by burglars. Police took 20 minutes to arrive.

After listening to conversations about Newtown, "I honestly don't think there is a middle to meet in," said Erik Shafer, a small business owner with a wife and two young daughters.

Then what does the future hold? He sees no end to gun violence, no matter what laws are passed.

"How do you prepare yourself for an infinite way that people can be shot and killed?" Erik Shafer responded. "It's tough. I really don't know what the answer is."

This can create new possibilities in your life. You will see, do and explore more things than you ever thought possible. You may even start a new model by doing something that has never been done before. Rather than following in other people's footsteps, try doing your own thing and forging your own path. Do you drink a lot? Are nicotine or other destructive habits something that harms you? The body is a source of great wonder and is vital to our life, as such respect is what it deserves. You can improve your life by replacing bad habits with good ones. Look at your life, what you are doing that may be harmful, and work on omitting things that need to be removed from your life. Getting healthier is a self improvement step that can have far-reaching positive repercussions. When you are healthy, you feel better and have more energy. Your mind is less cloudy, and you can even gain more free time and cut down on expenses because you won't need to visit the doctor as frequently. Make adopting healthier habits a goal.

Create a personal development plan by determining what your personal values are. If you go against your values, you are shooting yourself in the foot. Instead of this, you should focus your energy on the things that you want to develop that also go along with your own values. This allows you to implement personal and professional changes that will last forever. Are you having a hard time meeting that special someone? Perhaps you should try the Internet. Up to 40% of couples meet over the Internet nowadays. It is possible that certain someone is looking for you. Both sites have their strengths and weaknesses. Try to read encouraging books. Some people may look to a religious text, while others might look for inspiring quotes. You may need help staying on top of life and keeping your mind clear, and a trusted book whose words have meaning to you is a great resource to fall back on. Do you frequently consume alcohol? Do you do other harmful things like smoke cigarettes? Your body should be treated with the utmost respect. Eradicating negative behaviors is key to leading a better lifestyle. Take a hard look at your daily life and find things that could benefit from a positive restructuring.

Personal development starts with leadership. Leadership has many definitions, but many people think of it as "influence." Consider your leadership background. What are the specific incidences that made the biggest influence in your life? How did the events that took place have an effect on you? Evaluate attributes that you possess which contribute to your role as a team player. It is through these questions that you can best determine your role in a team environment. Usually what brings your happy mood down is stress. When stress happens in our minds, it also has detrimental affects on our physical health. To retain clarity of mind and the motivation to work towards our goals, it is critical to banish unnecessary stress from our minds. Each day, take time to quiet your mind and relax. Taking the time to renew your center will help you to find peace within yourself. Understand that there is a divide between where you are and where you wish to go. You need to acknowledge this so you can take your very first step. If you can't figure out what the difference is, chances are you won't find success in reaching your goals. Begin your self improvement with a look at your leadership qualities. When thinking about leadership, think about it in terms of your level of influence on the world around you. Reflect back on your leadership experiences. Are there events that have had major impacts on your life? How have those events changed you? What is the key element that makes you behave as a team player? By carefully evaluating these questions, you can increase your awareness of your ability to function well in a team setting.

Are you an alcohol abuser? Do you make a habit of smoking or engaging in other harmful vices? Our bodies are important to maintain, and should be treated with care. If you want to start improving your life, you have to stop engaging in harmful activities. Consider all of your habits and opt to omit habits from your life that can be described as harmful.

Choose one aspect that you want to improve and put your effort into that. Perhaps there are several areas you want to improve, but focus on just one at a time. Since new habits are most effective when introduced slowly, you are also more likely to having your changes stick around for the long term. Always aim to keep self-discipline a priority as you work on bettering yourself. Make sure that you develop self control skills. Conquer desires of the flesh, such as, overeating, lust, greed and drunkenness. If you can cut out the negative aspects of your personality you'll find your entire being becomes healthier and happier. Anytime and anywhere, be ready for when your ideas strike. Carry paper with you everywhere. Making quick notes about the inspiration as it strikes you will jog your memory and add to the potential that you will later incorporate into a thoughtful creative process.

Find texts and phrases that sooth and encourage you. Some people see it spiritually, whereas others just find it inspirationally. Keeping something on hand that you can revisit when necessary is a great way to improve your mindset, and navigate such situations more effectively.

Be the best you can be at what you are doing! Use your passions to fuel your journey of personal fulfillment. Now, you cannot be the complete best at everything you do, but it does not hurt to try. Trying for greatness helps inspire others to adapt to the same mindset, giving them a boost of self-worth. Do work you enjoy, complete it the best you can, and your self-esteem will grow stronger. Find a variety of ways to keep yourself motivated to improve your life. The work is hard, but the advice to get started can make the work fun.

"Basketball Wives: L.A." star Draya Michelle went in on Meek Mill's alleged former jumpoff, a girl named Brittney, on Twitter after the girl sent a "miss you" tweet to Meek. Draya has been denying for months that she was dating Meek, but the tweets seem to prove otherwise.

The two began trading insults online, but Brit took it to a different level when she started bashing Draya's parenting skills, and calling her son "an orphan."

While two?teachers?and three students were injured when the glass shattered in the 2001 attack on Granite Hills High School, Agundez confronted the assailant and wounded him before he could get inside the school and use his second weapon, a handgun.

The National Rifle Association's response to a Connecticut school massacre envisions, in part, having trained, armed volunteers in every school in America. But Agundez, school safety experts and school board members say there's a huge difference between a trained law enforcement officer who becomes part of the school family ? and a guard with a gun.

The NRA's proposal has sparked a debate across the country as gun control rises once again as a national issue. President Barack Obama promised to present a plan in January to confront gun violence in the aftermath of the killing of 20 Sandy Hook Elementary School students and six?teachers?in Newtown, Conn.

Agundez said what happened before the shooting in the San Diego County school should frame the debate over the NRA's proposal.

With a shooting at another county school just weeks before, Agundez had trained the staff in how to lock down the school, assigned evacuation points, instructed?teachers?to lock doors, close curtains and turn off the lights. He even told them computers should be used where possible to communicate, to lessen the chaos.

And his training? A former SWAT team member, Agundez' preparation placed him in simulated stressful situations and taught him to evade a shooter's bullets. And the kids in the school knew to follow his advice because they knew him. He spoke in their classrooms and counseled them when they came to him with problems.

In the wake of the Sandy Hook massacre, school boards, administrators,?teachers?and parents are reviewing their security measures.

School security officers can range from the best-trained police officers to unarmed private guards. Some big-city districts with gang problems and crime formed their own police agencies years ago. Others, after the murder of 13 people at Columbine High School in 1999, started joint agreements with local police departments to have officers assigned to schools ? even though that was no guarantee of preventing violence. A trained police officer at Columbine confronted one of two shooters but couldn't prevent the death of 13 people.

Trolley Company Leaves Wedding Business Rather Than Let Gay ...

Trying to reconcile your personal, religious beliefs that may conflict with running your business can be a difficult thing to juggle, which is apparently why the owner of popular trolley company has decided to walk away from the wedding business altogether rather than be hired by gay couples. The man says he didn?t want to compromise his Christian convictions by accepting same-sex couples who might hire a trolley for their wedding fun.

The owner of the Annapolis tour company says he?s going to ditch out on taking any couples and their wedding parties for rides because he?d have to take gay couples as well as the straight ones, and his religious beliefs conflict with that, reports the?Baltimore Sun.

To that end, he told the Annapolis Patch:??We?re a Christian-owned company, and we just can?t support gay marriages. We?re not trying to make a statement. We?re not trying to make a point. We?re just trying to be faithful Christians.?

He also wants his clients to side with him and lobby state lawmakers to institute an exemption for wedding vendors that would allow them to abstain from taking business due to religious beliefs. Same-sex marriage will become legal in Maryland ?in less than a week, so he?s cutting out while he can.

By walking away from the marriage business altogether, the owner is potentially avoiding discrimination lawsuits that might be brought against the company for refusing to cater to gay weddings.

?If they?re providing services to the public, they can?t discriminate who they provide their services to,? said the general counsel for the Maryland Commission on Civil Rights, according to the Baltimore Sun. That organization is the one which enforces the laws that don?t allow businesses to discriminate on the basis of ?things like race, sexual orientation, religion and more.

It?s his business, and therefore he can do what he wants, as long as he doesn?t allow anyone to use his service whatsoever. The owner said he will post a full explanation on his company website by Jan.

He did admit to Eye on Annapolis to sending an email to a potential straight client that read:??we used to do weddings until recently. But we?re a Christian-owned business, and we are not able to lend support to gay marriages. And as a public accommodation, we cannot discriminate between gay or straight couples, so we had to stop doing all wedding transportation.?

The man who?d wanted to hire the company for his heterosexual wedding replied in an email, via the Annapolis Patch:??It is your right to run your business any way you see fit, but let?s be honest here, you drive a trolley up and down a street. Not exactly God?s work.?

He?s not the only business to step away from thousands of dollars in potential wedding revenue. According to the?Maryland Wedding Professionals Association, the trolley company is the second vendor to get skittish over the same-sex marriage law.

We?ve seen discrimination accusations against other businesses elsewhere, including B&B owners in Canada who reportedly refused to rent a room to a gay couple?and were subsequently ordered to pay $4,500 to the couple to make up for it.

Family of Four Now Can Earn Nearly $48,000 Before Paying Provincial Income Tax

Indexation of provincial income tax will continue to protect Saskatchewan people from inflation and save Saskatchewan taxpayers an estimated $20.2 million in 2013.

Individual taxpayers now pay no Saskatchewan income tax on their first $18,455 of income while a family of four pays no Saskatchewan income tax on their first $47,790 of income - the highest tax-free income threshold for a family of four in Canada.

"A family of four with $50,000 annual income has now seen their provincial income tax cut by more than 90 per cent since our government took office," Finance Minister Ken Krawetz said. "In 2007, they would have paid about $2,300 in income tax and in 2013, they will pay about $200 in income tax - a savings of more than $2,000 a year.

"Ensuring that provincial taxes are competitive and as low as possible has always been a priority of this government and is an important part of our government's Plan for Growth. Continuing to index the income tax system to inflation every year is one of the ways we are keeping life in Saskatchewan affordable."

Since 2008, Saskatchewan residents have saved more than $300 million through lower personal income taxes, and 114,000 low-income Saskatchewan residents have been removed from the tax rolls. The Saskatchewan government has taken a series of steps to reduce personal income taxes over the past five years, including:

  • Increasing personal, spousal and child exemption amounts and introducing a new Low Income Tax Credit in 2008;
  • Introducing a new Active Families Benefit of $150 per child for cultural and sports activities in 2009;
  • Raising personal, spousal and child exemption amounts again in 2011;
  • Expanding the Active Families Benefit to include all children 17 and under (previously, it only covered ages six to 14) and introducing a new First-Time Homebuyers' Tax Credit in 2012; and
  • Indexing all income tax brackets and credit amounts each year to the rate of inflation to protect Saskatchewan taxpayers from "bracket creep." In 2013, all of these amounts are being increased by two per cent.

When income tax savings are combined with new tax reduction programs introduced since 2007 that include the refundable Low Income Tax Reduction and the Active Families Benefit, a single person with $25,000 annual income will benefit from $839 in lower provincial tax in 2013 than in 2007. A family of four with $50,000 combined income will see tax savings of $2,722 and a family of four with $75,000 combined income will see tax savings of $2,493, when comparing 2013 to 2007.

"These are significant savings for Saskatchewan families," Krawetz said. "By the end of 2013, that family of four with $50,000 income will have saved well over $12,000 through our government's tax reductions. Making life more affordable for families is a big part of the Saskatchewan Advantage."

6 Questions To Ask Before Moving Into a Nursing Home Facility | Bill ...

At some point, someone you love may make the transition from living at home to residing at an assisted living or nursing home facility. When should that transition occur, and what factors must be considered along the way? And what don?t these facilities tell you about?

1) When is it time? If an elder is a) safe and content at home, b) in reasonably stable health, c) can draw on personal or family resources for in-home care, d) has a sufficient ?rotation? of family or professional caregivers available so as not to exhaust loved ones, then there may be no compelling reason for that elder to enter a nursing home or assisted living facility.

If, on the other hand, an elder?s health notably worsens and caregiving strains your own health, relationships and/or resources, then the time may have arrived.

2) If it is time, is a nursing home really necessary? It may not be. Keep in mind that long term care insurance will often pay for home health aides, adult day care, and forms of at-home nursing. This is called respite care, and perhaps 10-15 hours of these services per week will do. Even without LTC coverage, this level of care may fit into your budget.

Trying to provide the equivalent of 24/7 nursing home care at home is much more expensive. Round-the-clock skilled nursing care delivered to a private residence can easily cost more than $100,000 a year.

3) Will an assisted living facility suffice? If an elder is ambulatory and reasonably healthy, it might. Assisted living (allowing an elder to have their own space plus quality care) costs much less than nursing home care, usually tens of thousands of dollars less annually. Most people pay for it using a combination of long term care insurance and private funds; in recent years, Medicaid has even begun to pick up the tab for select assisted living costs in some states.

4) Is an assisted living facility several steps above a nursing home? Its marketing will tell you so; truth be told, many assisted living facilities are comparatively brighter, more comfortable and cheaper than nursing homes.

Keep in mind, however: assisted-living facilities are not exactly remedies to the nursing home ?problem.? Many of these facilities do not offer their residents 24/7 medical attention and costs may climb if your loved one needs or wants more than the basics in terms of care or comfort.

5) How do you fund nursing home care? According to Genworth?s 2012 Cost of Care Survey, the median yearly cost of nursing home residency is now about $75,000. How much of that cost will a long term care policy absorb? Well, the benefit is usually a fixed dollar amount per day; $150 is a common figure, with benefits available for three years. If the daily benefit is $150, it means that LTC coverage can pick up 70-80% of typical annual nursing home expenses.

Are insurers raising premiums for LTC policies? Yes, significantly. As Money Magazine notes, the average annual premium that a healthy 55-year-old paid for a policy with a 3-year, $150-a-day benefit, 90-day deductible and 5% compound inflation protection was $1,524 in 2007. In 2012, it was $2,269; 49% higher. Money also notes that three years of LTC coverage is sufficient for 92% of elders.

Is long term care insurance worth the cost, and the possibility that the benefits may go unused? It may be if you are in the middle class. A recent report from the Society of Actuaries expresses the belief that households with $2 million or more in assets may not need LTC coverage at all, while those with savings of less than $250,000 may get much of the help they need from Medicaid when the time comes.

6) What isn?t said? Nursing homes and assisted living facilities are not predisposed to tell you about the downsides to their communities. So what isn?t usually expressed on the tour or in the brochure?

First, let?s talk about nursing homes. Genworth?s 2012 survey notes that the national median price for the typical shared room at a nursing home is $200 per day. Imagine handling that without help from LTC insurance or Medicaid. (Medicare will only help you meet nursing home expenses for less than a month.)

The Centers for Disease Control and Prevention state that an elder is twice as likely to suffer a fall in a nursing home as he or she is in the community. In fact, the CDC says that the average nursing home patient suffers 2.6 falls per year and that physical restraints do nothing to reduce the risk. If you have ever visited a nursing home and noticed a preponderance of residents in wheelchairs, it may be a response to liability as much as disability. A corollary to this: if residents are discouraged from being ambulatory, their leg strength may quickly diminish.

If your parent or grandparent has known and trusted a family doctor for decades, there is a risk that the relationship may wane or end after a move to an eldercare facility. Nursing home residents are placed under the care of one or more staff physicians who more or less become their primary doctors.

The rules and regulations governing care at assisted living facilities can vary greatly among states and counties, and while nursing home ratings are relatively easy to find online, reviews of assisted living facilities are not.

It is worth noting that 82% of assisted living facilities are for-profit businesses; on average, they draw about 19% of their incomes from Medicaid. In contrast, 68% of nursing homes are non-profits, and about 70% of their revenues come from Medicaid recipients.

You may know someone whose parent or grandparent was asked to leave a nursing home or assisted living community. This circumstance isn?t all that rare, especially if an elder copes poorly with the advance of Alzheimer?s disease. If a resident is particularly difficult, the possibility of eviction may come up; in most states, an eldercare facility doesn?t need to go to court for this.

When the time comes, stay involved. Our lives are often busier than we want them to be, but our elders count on us to be visible and engaged in their lives after they enter assisted living facilities or nursing homes. Your vigilance and support can make a difference in the experience for the one you love.

Stocks turn lower after consumer confidence sinks

(AP) ? Stocks fell Thursday, putting the market on track for its fourth straight loss, after consumer confidence fell sharply in December as Americans worried about higher taxes and government spending cuts.

The Dow Jones industrial average was down 75 points at 13,018 shortly after 10:30 a.m. It was wavering between small gains and losses before 10 a.m., when the Conference Board's report came out.

The Standard & Poor's 500 was down nine points at 1,410 and the Nasdaq composite index fell 20 points to 2,970.

The Conference Board said its consumer confidence index fell to 65.1, down sharply from 71.5 in November. That's the second straight decline and the lowest level since August.

"An unpleasant surprise," is how Hugh Johnson, chairman and chief investment officer of Hugh Johnson Advisors in Albany, N.Y., described the numbers. "People are worried."

Consumers' outlook for the next six months deteriorated to its lowest level since 2011. Lynn Franco, the board's director of economic indicators, said that decline is a signal that consumers are worried about the "fiscal cliff."

Investors are still digesting this week's news that the holiday shopping season so far has been the weakest since 2008, another sign that the economy is still struggling.

In Washington, the budget deadline neared with no resolution in sight. Higher taxes and government spending cuts kick in next week if Republicans and Democrats can't reach a budget compromise by Dec. 31. The uncertainty has made investors pull money out of stocks.

Senate Majority Leader Harry Reid said Thursday that it appears the government will miss the deadline. President Barack Obama called Reid as well as Republican Senate Minority Leader Mitch McConnell, Republican House Speaker John Boehner and Democratic House Minority Leader Nancy Pelosi to talk about the negotiations.

The "fiscal cliff" talks gained an extra layer of urgency late Wednesday with the news that the government is going to hit its $16.4 trillion borrowing limit ? its so-called debt ceiling ? on Monday.

Treasury Secretary Tim Geithner told Congress that he would use accounting measures to try to save approximately $200 billion. But those are stopgap measures, which would keep the government from going over its borrowing limit for probably only a couple of months.

Chipmaker Marvell Technology Group dropped 4 percent after the company lost a patent case brought by Carnegie Mellon University. Marvell said it would fight the $1.2 billion ruling.

In Japan, the benchmark Nikkei 225 index rose to its highest close since March 2011. The country is preparing for the incoming, pro-business prime minister, Shinzo Abe. He has called for more public works spending to reinvigorate the economy, and measures to drag the country out of deflation, or steadily declining prices.

Mother to Legislators: Do Not Deny Mental Health Services to Most ...

Editor's Note: This speech was presented at a legislative breakfast to local legislators because nonprofit mental health services in Connecticut have been cut dramatically with the most recent budget cuts.?

I?m Fran, and I?m the parent of two wonderful children: a 22-year-old daughter and a 24-year-old son, Josh.? Josh is funny, he?s smart, he?s very affectionate, we love him to death ... and he lives with developmental disabilities and mental illness. He operates within a pretty small world and does best when there is a lot of predictability in his routine and in his environment. He faces enormous obstacles in his life, but has the same needs for dignity and a satisfying quality of life that you and I share.?

He is fortunate to qualify for support through the state Department of Mental Health and Human Services, and extremely fortunate to receive that support through Gilead Community Services.?

I also have the privilege of serving on Gilead?s board of directors. This gives me the rare opportunity to see the delivery of services not only from Josh?s perspective, but also from an administrative point of view. What I see is an organization with enlightened administrators, and an extremely dedicated staff that has done heroic work to find creative ways to stretch dollars without compromising client services.?

But because of chronic underfunding, Gilead has reached the point where the dollars available simply won?t stretch any further. With the governor?s latest recissions, (see attached pdf) Gilead will have to cut four staff and 40 clients.? As a parent I worry.? Will Josh be one of those?? If so, where will he go???

Even if he?s one of the lucky ones who isn?t cut, his program staff?already stretched too thin?will be reduced again.? This will inevitably reduce the number of case managers who are available to maintain the security and predictability of his world, and respond to crises when they occur.? He will experience more stress, which increases his anxiety.?

If the source of his anxiety isn?t addressed, his behavior escalates, which often leads to threats and aggressive behavior. This sets in motion a whole cascade of events:? Mobile Crisis has to be called, police are involved, an ambulance is sent, he?s taken to the ER, and may be admitted to a psych ward for several days.? This is not only traumatic for Josh and for us, but it all takes place at great expense to the state.? I can guarantee you that as community supports continue to crumble, a similar scenario will be playing out with increasing frequency for many of Gilead?s clients.

I know that you will be leaving here to go make some very difficult budget decisions. As a parent, a Gilead board member, and a member of this community, I?m asking you to do three things:

  • Find your heart:?There is a children?s book called The Little Prince, in which a wise fox tells the Little Prince that ?It is only with the heart that one can see rightly.?? Our hearts tell us the truth.? When we look at any situation with our hearts, we know what needs to be done.?
  • Find your courage:?Have the courage to stand up and say ?We are better than this.? We do not turn our backs on our most vulnerable constituents because they do not have a voice, or a powerful lobby.??
  • Find a way:?Find a way to make our agencies whole.? Adequate funding creates jobs, it saves money, it saves lives, and it preserves our human dignity ? and Josh?s.? Find a way.? We can?t afford not to.?

Background

In 2006 Flanders wrote and distributed a public letter describing what really goes on at the ?gay clubs? for schoolchildren run by homosexual adults in towns across the country. He described his own sexual relations with two 14-year-old boys and other horrible things (drug use, pornography, etc.) at the ?gay youth club? in his town in Maine where he was an adult participant. He was later convicted and jailed for sexually molesting a teenage boy, along with other convictions, and is a
registered sex offender in Maine.

At that time, his 2006 letter appeared in the local media, which Flanders had encouraged. But MassResistance is using this letter to warn parents about the homosexual movement?s dangerous efforts to attract children ? and this angers the homosexual radicals. So last year Flanders (and his unidentified allies) threatened us.? And when we didn?t take it down they began a vicious campaign to ?punish? us and try to destroy us.

Over the past year, among other things, Flanders has: (a) filed a phony harassment order in Maine against MassResistance director Brian Camenker which was later thrown out by a judge; (b) threatened MassResistance?s web host company with legal action, causing them to close down our website and threatening our subsequent host company; (c) threatened other web sites across the country and in Canada which reported on Flanders? actions; (d) filed two legal injunctions against Camenker, both of which were rejected by a judge; and (e) filed a $1 million ?defamation? lawsuit against Camenker and MassResistance, which has been dismissed by a federal judge in Maine. (And recently there?s been even more, described in Part 2 below.)

Flanders has been spewing a stream of defamatory statements and lies about Camenker and MassResistance to anyone who will listen, including lawyers, web host companies, and even in legal documents.

Not backing down

Flanders? vicious tactics are unfortunately being more commonly used by homosexual activists against pro-family groups they want to punish or destroy. The difference here is that MassResistance beats them in court and keeps going ? which makes them furious!

The latest: Phony ?copyright infringement? claim

A favorite method of corporations, cults, and radical groups who want to get embarrassing material taken off the Internet is to falsely claim violation of a copyright (or trademark). Now the homosexual movement is doing it. Last week this became Flanders? latest tactic.

Unfortunately, they can take advantage of the Digital Millennium Copyright Act (DMC Act), passed in 1998, which makes it relatively easy for posted material to be immediately removed and tied up for an indefinite period of time ? maybe months or years ? by almost anyone willing to make a false or misleading claim.

Here?s the procedure outlined in the DMC Act (Sec. 512): All someone has to do is to fax the hosting company a copyright violation complaint letter. No matter how false or ridiculous the charges are, the company then permanently blocks all access to whatever material is described in the letter. If the affected website owner sends a properly worded ?counter-notice? outlining its innocence, then the material continues to be blocked, but gets un-blocked if the complainant does not file a legal action within 14 days. But if a legal action is filed, the material stays blocked until a court rules in the website?s favor, which could drag on indefinitely. Websites across America are vulnerable to this terrible abuse of the legal process by activists.

Technically, the DMC Act also says that a person who knowingly files a false copyright complaint can be held liable for any damages, including costs and attorneys? fees. (See Section 512(f).) But most of these activists seem undeterred by that, probably thinking that such a court action would be too difficult and expensive.

A hosting company may ignore the DMC Act and simply decide to allow the material to stay up, and let the courts decide. But then the company would also be liable for damages if the website lost in court, so few are willing to do that. Web hosting in the U.S. is price-competitive, and companies make very little profit from an individual customer. Thus they generally have no interest taking any stand to protect an individual website?s free speech rights.

The company we contracted with for our hosting, run by a fearless Christian, is actually a middleman ? so Flanders went to the much larger hosting company he contracts from ? which is not so fearless.

Flanders? copyright infringement notice: Absurd claims and lies

Homosexual activists will to go to outrageous lengths. In Flanders? copyright infringement notice which he faxed to the hosting company, he states under oath that the following are materials copyrighted by him, and which we have posted illegally:

?

  • The public letter that he wrote in 2006 about his involvement in the homosexual clubs for children. [NOT TRUE: A Maine District Court Judge ruled that we have a First Amendment right to publish that document.]
    ?
  • The court filings that he wrote regarding the cases against MassResistance and Camenker. [NOT TRUE: Court filings are public documents.]
    ?
  • The criminal background check on him from the State of Maine. [NOT TRUE: It is a public document which is not copyrighted by him.]
    ?
  • His police department mug shot. [NOT TRUE: It is a public document which is not copyrighted by him.]
    ?
  • A photograph of him from his website. [NOT TRUE: This is clearly and unequivocally "fair use" per US copyright law.]

?

In addition, Flanders includes in his copyright infringement notice a further narrative of outright lies and distortions about Camenker and MassResistance. For example, he claims that because we ?falsely accused him of crimes,? a court made a ?factual finding? that we harassed him (NOT true) and that we ?encouraged the public? to harass him (NOT true), etc. And of course, like other homosexual activists across the country attacking pro-family groups, Flanders repeats the phony and libelous writings of the extremist Southern Poverty Law Center (SPLC) listing hundreds of religious, civic, and mainstream pro-family groups like MassResistance as ?hate groups? similar to the KKK.

Woven into this are common homosexual activist tactics: (1) Personalizing themselves as the victims and (2) Employing whatever lies, distortions, or illegal tactics they wish.

?Counter-notice? to hosting company from our lawyers

Immediately after Flanders filed his notice, our lawyers at Thomas More Society drafted a ?counter notice? per the DMC Act, debunking the claims that Flanders made, which was then faxed to the host company. However, as described above, according to the DMC Act the material still stays blocked. The counter-notice simply gives Flanders and his allies 10-14 days to file a copyright action in court, which we?re sure he?ll do ? and which we?ll fight .

Note: The ?copyright infringement? tactic is not new. In 1939 a reporter named Alan Simpson (who later became a US Senator) published a version of Adolf Hitler?s Mein Kampf which included the anti-Semitic and militaristic portions left out of the American version of the book. Hitler sued Simpson for copyright infringement, and a Connecticut judge ruled in Hitler?s favor!

We?ll keep you informed on what happens.

The phony copyright infringement claim is just the latest abuse of the legal process that Flanders and his currently unseen allies are using to attempt to stop MassResistance, and to frighten everyone else.

Over the last several weeks we?ve been notified that Flanders is also:

A. Suing Thomas More Society for ?defamation?!

On November 14 the federal judge dismissed Flanders? absurd defamation case against Brian Camenker and MassResistance. However, Flanders has filed for a review of that decision and is amending it to add our legal counsel, the renowned Thomas More Society, as additional defendants! Flanders is claiming that the announcement which Thomas More Society made on its website about the dismissal of the case ? which includes a re-statement of the facts ? constitutes defamation of him!

This is another classic harassment tactic by the homosexual movement, and the left in general. They not only want to punish and intimidate pro-family people, but they harass the lawyers, too. And very often, this has the intended effect of scaring pro-family lawyers away from being aggressive or getting involved at all in these kinds of cases. But luckily, Thomas More Society is not intimidated!

B. Filing new ?harassment? action against MassResistance and Camenker

On October 22 the District Court Judge finally threw out the 2011 ?harassment? order against Camenker and MassResistance that Flanders had managed to fraudulently obtain. But that isn?t stopping him. On December 17, Flanders announced that he is initiating a new ?protection from harassment order? against Camenker.

This ?harassment complaint? will undoubtedly be as disingenuous and absurd as the previous one. As we reported, when Flanders tried to have the previous order ?enforced? through an injunction, the judge completely denied it and declared that MassResistance?s actions were perfectly legal.

But this represents another common homosexual activist tactic: Keep harassing through any means possible.

C. Announced that the FBI is ?investigating? Camenker and MassResistance

On December 19, Flanders wrote in an email to a web hosting company that ?the FBI is currently investigating Mr. Camenker? because, said Flanders, he feels the need ?to protect myself.? This is another incredible abuse, which unfortunately is likely to become more common as a tactic.

As we?ve recently reported, under the Obama Administration the FBI is now embracing the homosexual movement and ?reaching out to the gay and transgender community.? (The FBI also now treats the extremist SPLC as a ?reliable source.?) Thus, it doesn?t surprise us that Flanders would have relatively easy access to them. We intend to get to the bottom of this.

We want to say that we are very proud of our legal team at the Thomas More Society in Chicago. No matter what Flanders and his friends in the homosexual movement throw at us ? or at our lawyers ? they are sticking by us and fighting strong.

Unfortunately, the battle is not going well. The radical and militant homosexual movement has become the 800-pound gorilla in the room that the mainstream conservative movement pretends it doesn?t even see. And even worse, many are starting to view radicals? victory as inevitable, so conservatives turn away, give up, and talk about other things.

Most conservatives are in denial about the vicious and relentless nature of the homosexual movement. They are afraid ? and hope that by placating them and moderating their opposition, it will persuade them to slow their aggressive push to change our culture.

For example, how many pro-family groups, for example, talk about ?gay marriage? in the abstract but are terrified to anger the homosexual groups by discussing the perverted behavior? But if anything, the opposite is true. Silence on that only makes them bolder, more vicious, and more aggressive.

We know of pro-family groups that caved in to Flanders? early demands to take down the incriminating letter. And others who were afraid to put it up once they saw what he did to us. On the other hand, every time someone publicly fights back and wins, it has an effect. It pushes the radicals back a little and in many cases it energizes many, many others on our side.

So don?t let the ?moderate? conservatives drag you down and make you more afraid. Fight back with MassResistance!

Children jubilateParents have been advised to teach their children and house-helps to be security conscious to prevent the incidence of robbery at all times, and especially during the yuletide.

Police Superintendent Aduhene Benieh, Airport District Police Commander who gave the advice on Thursday stressed that it was during the Christmas and other holidays, where people were generally in merry mood, that miscreants exploited the situation to undertake their criminal activities.

Speaking to the Ghana News Agency (GNA) in Accra, he proposed that homeowners and households install alarm devices to alert them and their neighbours of the activities of intruders when they were away from home.

Mr Benieh underscored the importance of training children and particularly house attendants not to allow any stranger in the house or inside their rooms.

He said such criminals who were allowed in when parents were not at home, may either rob the house or survey the items their victims possessed in order to launch an attack later.

Mr Benieh was optimistic that a good reminder to the children and house attendants on such security? guidelines would achieve good results.

He reminded the business communities and traders to be wary of the activities of fraudsters during the holidays.

Mr Benieh said, ?businessmen must get to the approved offices and institutions or agencies to transact their business activities. Such due diligence would pay off?.

In a related development, the GNA?s findings revealed that there had not been any recorded incidents of criminal activity at the Airport and Nima Police Stations during the Christmas season.
